President Uhuru Kenyatta and Deputy President William Ruto risk a Sh2 Million fine, a conviction of six years in jail or both.

This is after they were accused of launching a government portal, www.delivery.go.ke, to highlight the achievements of the government, which is said to be against the law.


According to a report by NTV, section 14 of the Election Offences Act prohibits a candidate, referendum committee or any other person from using public resources for the purpose of campaigning during an election or referendum.

The Act also provides that, “no government shall publish any achievements or advertisements of the respective government, either in the print media, electronic media or by way of banners or hoardings in public places during the election period.”

Former Law Society of Kenya (LSK) CEO Apollo Mboya has since written to the Director of Public Prosecutions (DPP) requesting that they be charged within seven days for contravening the law.

The lawyer highlighted the definition of the election period according to section 2 of the mentioned Act as, “the period between the publication of a notice by the Electoral Commission for presidential, parliamentary or county election as provided under the Elections Act, 2011 and the gazettement of the election results.”

He further warned that he would privately sue the leaders if the DPP failed to act on his request.
The President is, however, shielded from criminal prosecution during his term in office, given his constitutional functions, duties and powers.

Last week, Kenyatta officially launched the ‘My Government Portal’ to help Kenyans track all development projects carried out by the Jubilee administration in the last four years.
